Prompt justice delivery utmost for promoting rule of law

Prompt justice delivery is a prerequisite to ensure rule of law in the country.


May 9 is annually marked as the Law Day in the county. The day is marked as the Law Day on the occasion of establishment of an autonomous and independent judiciary in the country in 2008 BS (1951 AD). The central court was established on Baishakh 26, 2008 (May 9, 1951).


Talking to RSS in the context of the Law Day, former chief justice Kalyan Shrestha said that it was the day to evaluate the judiciary’s performance and whether the service recipients were getting accessible and prompt justice or not.


He further focused on easy and prompt justice delivery adding that the public expect justice in time. The experts believe that the state cannot function properly and impartially unless rule of law was ensured in the country.


Similarly, Minister for Law, Justice and Parliamentary Affairs Sher Bahadur Tamang shared that it was the phase of enacting laws for the people after the state adopted new federal set up. Minister Tamang, talking to RSS, said that different laws should be enacted to implement the federalism.


The government has intensified the law drafting process after forming a law draft committee led by attorney general Agni Kharel. However, legal practitioners annually express sadness over the attack on independent judiciary from several quarters.


Independence of judiciary generally means it is free from other organ of the state, especially executive, and legislative body. It must forward its businesses without any interference and coercion.


The judiciary is facing acute workloads as they have to settle thousands of cases.


According to annual report of the Supreme Court (2073/074 BS), about 61 percent of cases were settled in the previous fiscal year.


There were 254,529 cases in the SC, lower courts and tribunals and 157,000 cases were settled in the fiscal year.


Similarly, 118,251 cases were settled of the 207,361 cases in the last fiscal year. It shows that about 4.85 % more cases were settled in the last fiscal year in comparison to the previous one.
